On the rulemaking opinion: based on U.S. Supreme Court precedent and other legal authorities, the rulemaking provisions of REPLICA are similar, if not identical, to those of other regulatory compacts, and are consistent with the Court's decision in State of West Virginia ex rel. Dyer v. Sims, 341 U.S. 22 (1951), which upheld a similar challenge to a compact rulemaking statute.
